TOWN OF MOUNT HOPE    

ZONING BOARD OF APPEALS MEETING     

June 4, 2025, – 7:00 P.M.

 

Present: Vincent Galligan-Chairman; Board Members: Robert Wheeling, Mary Carver, Rita Rich Alternate; Kenneth Hilley; Zoning Board Attorney: Alex Smith; Town Engineer: Jason Pitingaro; Christopher Furman, Town Board Liaison for ZBA

Absent: Kathy Hosking

Meeting called to order at 7:00 p.m. by the Chairman.

Pledge of Allegiance led by the Chairman.

Motion made by R. Wheeling to accept the minutes of May 2025; second by M. Carver.  All in favor; no opposition.

No Correspondence

                        Application of Christopher & Melissa Prendys Public Hearing-Tax Map Section 22; Block 3; Lot 1; in the RES 1 Zone.  Property is located at 4 Elm Road.  The applicant was denied an addition on the grounds of “250-6” – setbacks.

           

            Present:  Mr. Prendy

Mr. Prendy explained that he has a very a small lot; the house was pre-existing on the lot when they bought it.  His family has grown, they have two children and he does work from home. He is looking to add on to a space on the rear of the house that has an existing deck which will be taken off and use it as a dedicated office space; he is working in a spot in the kitchen now where everyone passes through.   He has a third of an acre.  The board asked if he had ever received or asked for any additional variances; response was “no”.  Alex Smith asked how much of a variance he would need; Mr. Prendy responded that his architect has not determined yet what he will need; Jason Pitingaro stated you should ask for the full amount of “feet” you will need of the non-conformity.  Mr. Prendy stated that will be 17 ft.  The Chairman asked if there was anyone from the public with questions and or comments; there was no one.  Motion made by M. Carver to close the public hearing; second by R. Wheeling; all in favor; no one opposed.  Chairman Galligan requested a motion to grant the full amount of the non-conformity and grant the 17 ft. variance; Motion made by R. Wheeling; second by K. Hilley; All in favor; no one opposed.  Counselor Smith will write the resolution and motion made by R. Wheeling that the Board will return review this resolution; second by K. Hilley for the Chairman to sign; all in favor; no one opposed.  

                        OYA Pine Grove Road LLC – Tax Map Section 1; Block 1; Lot 127 in the RES 1 Zone Proposed Solar Farm – This applicant did not appear before the Board.

                        Paul Barth Application –Tax Map Section 12; Block 1; Lot 56.1 in the B-1 Zone – Disapproved for 250-29B.  

                       

                        After research by the ZBA Attorney it was advised that this application should be referred to the Town Board for consideration of a home in a non-conforming zone. 

Chairman Galligan discussed the July meeting and absences, the Board decided not to have a meeting in July – the next ZBA meeting will be on August 6th.

Motion made by M. Carver to close the meeting; second by R. Wheeling.  All in favor.
